Day 39: Supplemental/Special Needs Trusts

MSR Legal & Consulting Services is a full-service special needs law practice, with a primary focus on handling children’s special education cases as swiftly as possible. Additionally, I offer disability advocacy, like representation in guardianship petitions and Medicaid fair hearings. So many special needs parents are consumed with their child’s daily learning and care and have not thought about planning for long-term care or asset protection.

A Special Needs Trust or Supplemental Needs Trust can help maximize funds available to an individual with a disability without those funds counted as a resource for Medicaid or SSI eligibility. For example, if you’re intending to leave behind an inheritance of property to your child, and your child relies on government benefits such as Medicaid, your child may end up with too many assets to maintain eligibility for those benefits. A Special Needs Trust would allow a Trustee to pay for your child’s expenses while still maintaining his or her government benefits.

Supplemental Needs Trusts are also very useful for personal injury plaintiffs who secure lump sum payments. To discuss guardianship and the creation of a Supplemental Needs Trust, book a virtual consultation on my website, https://www.MSRLegal.ORG/Book-Your-Consultation. Follow @MSRLegalConsulting on Instagram as I post about the evolving landscape of special education in the new normal of social distancing.

As always, be well.
