Day 42: What Exactly is 'Compensatory Education'?

Compensatory Education is a legal remedy available when a child has not received an appropriate education. The idea behind compensatory education is to make up the instruction that the student was deprived of during the academic year. Compensatory education may also be available for students who have aged out of school.

If you’re a parent who is struggling with crisis schooling and concerned about your child’s learning, you should know that you have the right to protect your child’s educational interests. The amount and type of compensatory education will depend on the nature of your child’s disability, your child’s specialized needs, and his or her current abilities.

As our government moves towards a plan for reopening schools, think about the type of compensatory education that your child might need. Below are just a few examples:

  • 1:1 direct instruction through distance learning;

  • Remedial tutoring at home or at a center outside of school hours;

  • Academic remediation or behavioral therapy during the school day within a specialized private school;

  • Home-based or center-based Applied Behavior Analysis (“ABA”) therapy, speech-language therapy, occupational therapy, physical therapy, transition services, and/or psychological services; and

  • Continued schooling and related services for six weeks this summer and/or during a future summer.
